Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Pedometer Step Counter provided by HK MobiUnity. By downloading, accessing, installing, purchasing, subscribing to, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

These Terms should be read together with our Privacy Policy and Subscription Terms.

2. App Store and Google Play Terms

If you download the App from Apple App Store or Google Play Store, your use of the App is also subject to the terms, rules, and policies of the relevant platform. In the event of a conflict between these Terms and mandatory platform rules, the applicable platform rules control to the extent required.

3. Eligibility

You must be at least 13 years old or the minimum age required in your country or region to use the App. If you are under the age of majority, you may use the App only with consent and supervision from a parent or legal guardian.

The App does not provide a self-operated in-app registration, login, or user account system. App Store and Google Play accounts are managed by the relevant platform and are not accounts provided by the App.

4. License to Use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial, lawful use. You do not acquire ownership of the App, software, source code, design, content, trademarks, or other intellectual property.

5. Acceptable Use

You agree not to use the App for unlawful, harmful, fraudulent, abusive, deceptive, unsafe, or unauthorized purposes; reverse engineer, decompile, modify, copy, distribute, sell, lease, or sublicense the App except where permitted by law; bypass subscription, payment, entitlement, access control, security, or technical restrictions; interfere with the App, servers, networks, billing systems, or third-party services; use automated scripts, bots, scraping, or unauthorized access methods; or violate Apple App Store, Google Play, or third-party service policies.

6. App Features and Changes

The App provides step counting, walking distance, calories, active time, goals, trends, reports, route maps, badges, Health sync, local audio playback selected by the user, and walking history. Some features may require network access, device permissions, compatible devices, a supported operating system, an app store account, an active subscription, or third-party service availability.

We may add, modify, suspend, or remove features from time to time. We do not guarantee that all features will be available at all times, in all countries, on all devices, or in all app versions.

7. Local Data and Backups

Some data may be stored locally on your device, including activity records, goals, routes, preferences, badges, and history. You are responsible for managing and backing up local data where supported. Deleting the App, changing devices, clearing storage, or system failure may result in loss of local data.

8. User Content

The App does not provide public posting, public social sharing, upload, comments, messaging, or public user-generated content features. Activity records, routes, goals, badges, preferences, selected local audio files, and walking history are used for the App experience and are not public user content.

9. No Professional Advice

The App is a general wellness and activity tracking tool. Step counts, calories, distances, active time, route records, pace, trends, reports, and Health sync results are estimates and may depend on device sensors, operating system services, GPS availability, Google Maps, HealthKit, Health Connect, user settings, and environmental conditions.

The App does not provide medical, emergency, safety, legal, financial, tax, or other professional advice. You should consult qualified professionals where appropriate and should not rely on the App for medical diagnosis, treatment, emergency response, or safety-critical navigation.

10. Subscriptions and Paid Features

The App may offer free features and premium subscriptions through the Apple App Store on iOS and Google Play Billing on Android. Premium features may include goal setting, activity trend analysis, health data synchronization, activity tracking, route tools, badges, and motivation tools. Subscription entitlements are associated with the platform account used for purchase and do not interoperate between iOS and Android unless expressly stated in the App or purchase flow.

Purchases made through Apple App Store or Google Play are processed by the relevant platform. Subscription billing, cancellation, renewal, restore purchase, and refund rules are described in our Subscription Terms and the applicable app marketplace rules.

11. Refunds

Refunds for purchases made through Apple App Store are handled through Apple's refund process. Refunds for purchases made through Google Play are handled through Google Play's refund process where applicable. Platform refund decisions are made by the relevant platform. We may help locate orders or explain entitlements, but we do not control platform refund decisions.

12. Third-Party Services

The App may integrate with or rely on Apple App Store, StoreKit, Google Play, Apple Health, HealthKit, Android Health Connect, Google Maps Platform, device motion services, location services, system file picker, audio playback services, Apple Search Ads attribution, in-app review, platform analytics, crash diagnostics, and support email services. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services, content, availability, security, or practices except where required by law.

13. Intellectual Property

The App, including software, design, interface, graphics, logos, text, features, and other materials, is owned by us or our licensors and is protected by intellectual property laws. You may not use our name, trademarks, branding, or assets without prior written permission.

14. Feedback

If you provide feedback, suggestions, ideas, or bug reports, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use them for any purpose without compensation, unless prohibited by law.

15. Termination

We may suspend or terminate your access to the App if you violate these Terms, misuse the App, create legal risk, violate platform rules, or harm users, us, or third parties. You may stop using the App at any time. Uninstalling the App does not cancel an active subscription; subscriptions must be cancelled through the relevant platform settings.

16. Disclaimers

The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, availability, non-infringement, and uninterrupted operation.

17. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or related to your use of the App.

To the maximum extent permitted by law, our total liability for any claim related to the App will not exceed the amount you paid for the App or subscription during the twelve months before the claim arose. For free use, liability is limited to the minimum amount permitted by applicable law. Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

18. Indemnification

Where permitted by law, you agree to defend, indemnify, and hold harmless us, our affiliates, officers, employees, contractors, and partners from claims, liabilities, damages, losses, and expenses arising from your use of the App, your violation of these Terms, or your violation of any law or third-party rights.

19. Platform-Specific Terms

For Apple platforms, these Terms are between you and us, not Apple. Apple is not responsible for maintenance or support. Apple and its subsidiaries are third-party beneficiaries of the Apple platform terms and may enforce those terms. You must also comply with Apple Media Services Terms and Conditions.

For Google Play, downloads, purchases, subscriptions, refunds, and payment processing may be subject to Google Play terms and payment policies. Google is not a party to these Terms unless platform rules require otherwise.

20. Export Control and Sanctions

You represent that you are not located in a country or region subject to applicable sanctions or export control restrictions and are not listed on relevant restricted-party lists. You may not use the App in violation of applicable export control, sanctions, or trade restrictions.

21. Governing Law and Dispute Resolution

These Terms are governed by the laws of Hong Kong, without regard to conflict-of-law rules. Subject to mandatory consumer protection rules that may apply in your location, disputes arising from or relating to these Terms or the App shall be submitted to the courts of Hong Kong that have jurisdiction. Mandatory rights granted by the laws of your location are not affected.

22. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted in the App, on our website, or through other appropriate channels. Continued use of the App after changes become effective means you accept the updated Terms, unless applicable law requires additional consent.
